                            AGREED REPORT OF GENERAL MAGISTRATE AND NOTICE OF FILING AND CERTIFICATE OF SERVICE

THIS MATTER came to be heard on, XXXXX XX, 20__, pursuant to the Order of Referral signed by the Court XXXXXX XX, 20__, for Trial upon Petition for Dissolution of Marriage filed on XXXXXXXX XX, 20__.     The General Magistrate, having heard the testimony, reviewed the files and having considered all relevant evidence, and being otherwise fully advised in the premises, hereby files this Report and Recommendation:

 

  1. The General Magistrate reports the following findings from the evidence submitted to the undersigned at the above hearing:

 

  1. Electronic reporting was provided.

 

  1. The court has jurisdiction over the parties and the subject matter of the motion was properly referred to the General Magistrate.

 

  1. Petitioner was present and represented by Counsel, Larry D. Schott, Esquire.

 

  1. Respondent was present and was represented by XXXXXXXX, Esquire.

 

  1. At least one party has been a resident of the State of Florida for more than six months immediately before filing the Petition for Dissolution of Marriage.

 

  1. The marriage between the parties is irretrievably broken.

 

  1. The parties have voluntarily entered into an agreement which was announced in open court and is attached hereto as “ Exhibit 1”.

 

  1. Each party has filed the required Family Law Financial Affidavit.

 

  1. The parties have 2 minor children:

FP, born on xx/xx/20__ and AP, born on xx/xx/20__

 

  1.    Husband has a gross monthly income in the amount of $1,621.42, and a net monthly income of $1,421.90.   Wife has a gross monthly income of $5,304.41, and a net monthly income of $4,531.18.    The Wife pays $342.33 per month for health dental, and vision insurance for the children.
  2. Health/Dental and Vision Insurance. The Wife shall be required to continue to maintain health, dental, and vision insurance for the parties’ minor children, so long as reasonable in cost and accessible to the children.
  3. The parties should reasonable and necessary uninsured medical, dental, prescription drug and orthodontic costs for the minor children shall be assessed with the Husband responsible for 24% and the Mother responsible for 76% pursuant to the child support guidelines worksheet (attached hereto as Exhibit “2”)
  4. In view of the above findings, the General Magistrate recommends that the Court adopt the following provisions as its Order upon the matters referred to the General Magistrate:

 

  1. The marriage between the parties is dissolved, and the parties are restored to the status of being single.
  2.   The Agreement/Parenting Plan attached as Exhibit 1, is hereby ratified by the Court.  The Parties shall abide by the terms of the Agreement/Parenting Plan.
  3. Commencing on XXXX XX, 20__, the Husband shall be responsible to pay child support in the amount of $494.84 per month until  XXXX XX, 20__ when the oldest child reaches 18 and/or until the child graduates high school.  The Husband’s child support obligation for the remaining minor child shall be $311.04 per month or until such time as the minor child dies, joins the armed forces, or otherwise becomes emancipated, whichever first occurs.   A child support guideline worksheet is attached hereto as Exhibit “2” and Exhibit “3”.

 

  1. The court finds it is in the children’s best interest that all child support be paid directly to the XXXXXXXXXXX, XXXXXXX, XXXXXXXXXXX through Income Withholding Order.

The payor shall list the case number and the parties’ names on all checks.  The (recipient) shall be responsible for setting up an account with the child support depository. 

 

  1. Health/Dental and Vision Insurance. The Wife shall be required to continue to maintain health, dental, and vision insurance for the parties’ minor children, so long as reasonable in cost and accessible to the children.
  2. Reasonable and necessary uninsured medical, dental, prescription drug and orthodontic costs for the minor children shall be assessed with the Husband responsible for 24% and the Mother responsible for 76% pursuant to the child support guidelines worksheet (attached hereto as Exhibit “2”)
  3. The wife’s former name is restored to: “Jane Brown”.

 

  1. The Court reserves jurisdiction over the parties and the subject matter hereto to enter further Order as it deems just and proper.
