MEDIATED SETTLEMENT AGREEMENT

MEDIATED SETTLEMENT AGREEMENT

The Parties met at mediation on XXXXXX XX, 20__ and agreed as follows:

  1. Timesharing/Parenting Plan:
  2. The Parties shall attend co-parenting classes at FACES, XXXXXXXXXXXXXX
  3. The Father’s timesharing will be pursuant to the Parenting Plan, attached hereto as Exhibit “A”.
  4. The parties shall continue to meet with the allergist at Florida Allergy and Asthma in Pembroke Pines as recommended by the allergist.
  5. Both parties shall follow the recommendations of the allergist and before leaving the appointment shall set a return date with the allergist to follow up with any additional questions or concerns. The parties agree that they may be able to record the discussions with the allergist so that if there is a conflict, that recording shall be admissible in court.
  6. Neither party will schedule other plans for the child during the other party’s timesharing.
  7. The parties shall equally share any uncovered medical expenses for the child.
  8. Real Property:
  9. The parties jointly own marital property located at: XXXXXXXXXXXXXXXXXX

The property shall be listed for sale (90 days prior to lease expiring) by a mutually agreed upon realtor (upon the expiration of the lease in November or January) and the equity shall be split 50/50 between the parties. Parties to follow the realtor’s recommendations as to sales price. After expiration of the lease and until the home is sold, the above-referenced expenses of the home shall be split 50/50. A copy of the lease shall be provided to the Wife.

The Husband shall be responsible for the mortgage, taxes, insurance and all other incident expenses until the property is sold.

  1. The parties own property on Commercial Blvd., located at: XXXXXXXXXXXX

The Husband shall retain said property which shall be his separate property. Wife shall sign a Quit Claim Deed transferring said property to Husband upon presentation.

  1. The Wife owns non-marital property located at: XXXXXXXXXXX, which is titled in her sole name. The Wife shall retain this property as her separate property.
  2. Marital Debt:
  3. The parties shall be equally responsible for the Chase credit card debt in the approximate amount of $5,000.00. The parties shall make the minimum monthly payments to Chase until the balance is paid in full.
  4. Assets:
  5. The Wife shall retain her retirement account.
  6. The Husband shall retain his retirement account.
  7. The parties shall retain their separate bank accounts.
  8. There are no other marital assets or liabilities that require equitable distribution.
  9. Child Support:
  10. The Husband shall pay child support to the Wife pursuant to the Child Support Guidelines attached hereto as Exhibit “B”.
